- The Hirer warrants that the subjects let are to be used for the purposes of a holiday and so accepts that the letting is a holiday let to which Section 12(2) and paragraph 8 of Schedule 4 of the Housing (Scotland) Act 1988 apply, namely, “a tenancy the purpose of which is to confer on the tenant the right to occupy the house for a holiday.”
- For the avoidance of doubt throughout the letting process Fife Cottages are acting as agent on behalf of the property owner.
- “Lessor” means the property owner or Fife Cottages acting as the owner’s agent.
- A contract of booking is made when we have received your booking details and the reservation deposit and we have confirmed the booking to you.
- The Hirer shall not sub-let the premises or any part thereof.
- The number of people occupying the premises shall not exceed the number stated for the premises.
- The Hirer binds and is obliged to vacate the hired premises without demand at the termination of the period of hire.
- The Hirer binds and obliges him/herself to pay to the Lessor in respect of any loss or damage beyond fair wear and tear.
- The Hirer shall, at all times, keep the hired premises in a clean and tidy condition and leave them in this way. A charge may apply for an unreasonable amount of cleaning at the termination of hire.
- The Hirer shall undertake to prevent any member of their party from causing a nuisance or disturbance to other residents or occupiers.
- The Hirer undertakes to leave the hired premises secure if left unoccupied during the period of let.
- To permit the owners and their agents reasonable access to the property.
- Cancellation of bookings, the following terms and charges apply:-
- more than 6 months prior to arrival – full refund minus 50 UK pounds admin fee
- between 6 months and 60 days – 30% of full amount.
- 30-59 days – 50% of full amount.
- 29 days or less – full rental is payable.
- Covid 19 – over and above the Cancellation Policy shown above should a booking be unable to proceed due to Covid restrictions then a full refund – less a £50 Admin Fee – will be offered. If regulations would allow the Hirer to travel and the property is available then a cancellation in these circumstances would be administered in accordance with the standard Cancellation Policy. For the avoidance of doubt no refund will be offered if a cancellation is sought where a member of the party has contracted Covid or is being required to self-isolate. Both of these situations can be covered with appropriate travel insurance.
- Please consider obtaining personal holiday insurance to cover this and other potential losses.
- In the event of the Lessor cancelling the booking a full refund of all monies will be given.
- The Lessor may treat the booking as cancelled if the balance of the hire fee is not received by the period specified in the booking agreement (42 days prior to arrival date). Every effort will be made to re-let the property and a refund given.
- The Hirer undertakes to relieve the Lessor from any liability for damage or injury however caused by any member of their party.
- The Lessor, their agents or employees, accept no responsibility for loss, injury or damage to any member of the Hirer’s party or their property, howsoever caused, arising in any manner out of the let of the premises.
